  1. What is The Fairytale's Platform Fee?

Platform fee is levied by The Fairytale to sustain the efficient operations and continuous improvement of the platform, for a hassle-free app experience.

  1. Refund of Platform Fee
  2. a) If the order is lost or undelivered to the preferred location, the complete order amount will be refunded if paid online, including the platform fee.
  3. b) If a customer cancels an order partially or returns an order, platform charges will not be refunded.
  4. c) Platform charges will be refunded in case of a full order cancellation
  5. d) For accounts whose return behavior does not adhere to our fair usage policy, platform fee will be non-refundable irrespective of order value*.

*Order value is calculated after applying discounts/VAT/GST or any other applicable charges.

  1. What is The Fairytale's Shipping Fee?

Shipping fee is charged towards providing delivery and post order services excluding returns.

Shipping is a value-added service charge levied under one of the following circumstances:

  1. a) Orders below INR 1499 for all categories are charged with Shipping fee.
  2. b) The final shipping fee is calculated post application of any 'coupon benefit' and offers
  3. c) The threshold values can change, please review the Shipping Fee at the time of checkout
  4. Refund of Shipping Fee
  5. a) If the entire order is lost or undelivered to the preferred location, the complete order amount will be refunded if paid online, including the shipping fee.
  6. b) If an order is cancelled partially, shipping charges will not be refunded. In case of whole order cancellation, shipping charges will be refunded.
  7. c) In case item/ order is returned by the customer, shipping fee is not refunded
  8. d) For accounts whose return behavior does not adhere to our fair usage policy, shipping fee will be non-refundable irrespective of order value*.
  9. e) If a customer has placed two or more orders in the same day below Rs.1499, each order is subjected to shipping fee and the shipping fee cannot be waived off by contacting customer service.

  1. What is The Fairytale’s Fair Usage Policy?

We always strive to provide the best experience to our customers. However, very rarely, there are some accounts that misuse our customer-friendly return service. These accounts typically return more items compared to an average user or frequently choose to not accept their shipments. The Fairytale reserves the rights to levy shipping fee on customers whose return rates are higher than average and are not adhering to the liberal returns service.

  1. How do I check the status of my order?

Please tap on “My Orders” section under main menu of App/Website to check your order status.

  1. How can I check if The Fairytale delivers to my PIN Code?

You can find out if The Fairytale delivers to your PIN Code using the courier serviceability tool available on the product page or on the checkout page. Please tap on “Check Delivery options” and enter your area PIN code in the respective field to get the required information about standard order delivery time and availability of Cash on Delivery for the Product selected. The PIN codes serviced by us are frequently updated, so if we do not deliver to your PIN code today, please come back and check to see if this has changed.

  1. How are orders placed on The Fairytale delivered to me?

All orders placed on The Fairytale are dispatched through our carrier partner Shiprocket.

  1. Does The Fairytale deliver products outside India?

No. At this point, The Fairytale delivers products only within India.

  1. How can I get my order delivered faster?

Sorry, currently we do not have any service available to expedite the order delivery. In future, if we are offering such service and your area Pin code is serviceable, you will receive a communication from our end.

  1. I have received a partial item/partial order or an Untenanted/Void packet?

Kindly reach out to us for pilferage within 72 hours of delivery, failing which the claim will not be entertained. Whilst we investigate, request you to please make note of the below pointers:

  1. a) Please do not use the item for which claim is being raised.
  2. b) You may be required to information’s like, short description of the case (A few questions will be asked to help us understand the scenario)
  3. c) The video of the packet and other boxes (If any) (Try to cover the sides which look tampered/damaged as per the Users

The refund for prepaid/Cash on delivery orders will be done after the investigation

You may not be liable for a refund, if you fall in any of the scenarios stated below:

  1. Failure to provide adequate information about the case.
  2. Failure to provide snapshots of the packet and box (if any)
  3. If a pilferage delivery was received, pilferage claims must be made the same day.
  4. You must not dispose of the packaging for 3 - 4 days post - delivery. We might need to pick-up your packaging for investigation at our end.
  5. You have used the item for which claim was raised.

In case of a component missing from a multi-component item, only exchange return option would be provided basis serviceability and product type

 

 

Cancellations and Modifications

 

  1. What is The Fairytale’s Cancellation Policy?

You can now cancel an order when it is in packed/shipped status, as long as the cancel option is available on Website. This includes items purchased on sale also. Any amount paid will be credited into the same payment mode using which the payment was made

  1. Can I modify the shipping address of my order after it has been placed?

Yes, You can modify the shipping address of your order before we have processed (packed) it, by contacting customer support.

  1. How do I cancel my Order?

Tap on “My Orders” section under the main menu of your Website and then select the item or order you want to cancel

  1. I just cancelled my order. When will I receive my refund?

If you had selected Cash on Delivery, there is no amount to be refunded because you haven't paid for your order. For payments made via Credit Card, Debit Card, Net Banking, or Wallet you will receive refund into the source account within 7-10 days from the time of order cancellation.

 

 

Returns and Exchange

  1. What is The Fairytale’s Return and Exchange Policy? How does it work?

The Fairytale returns and exchange policy gives you an option to return or exchange items purchased on The Fairytale for any reason within the specified return/exchange period (check product details page for the same). Returns will be picked from the same address where the product is delivered. Feel free to try on a product but all we ask is that the product remains unused and is preserved in its original condition along with the tags and packaging. In case a Seal Tag is received with the item, ensure that it remains attached & intact with the product to avoid any hassles in the event of a return/exchange. There are two ways to return the product to us:

  1. Pick up: In most locations, we offer a pick up service. You will see a pickup option when you submit a return request. A return pick up fee will be charged to you which will be deducted from your paid amount.
  2. Self-Ship: If we don't offer a pick up at your location, in such cases, we will provide the return shipping address. You will need to share the scanned copy of the courier receipt with us.

During Pick Up, our delivery agent may do a quality check on the return. For a successful pick up, make sure that the item returning meets all the return criteria. In the cases of refund for return, refund will be initiated after the product has been received at our warehouse and has passed a quality check. A video will be made for the same and uploaded online for proof of package received. If the picked up product does not pass the quality check, we shall not initiate a refund. If you choose to exchange the item for reason of mismatch of size or receipt of a defective item (or any other issue which arose due to mistake by The Fairytale), you will be provided with a replacement of the item, free of cost. However all exchanges are subject to stock availability and subject to your address being serviceable for an exchange. If you choose to exchange an item, a new delivery representative will deliver the new item to you after the original order has been collected and reached the warehouse. Please note that we offer you an option to exchange items purchased by you on The Fairytale for same or different sizes of same style or for any other item of the same or different value from The Fairytale within the specified exchange period subject to your address being serviceable for an exchange.

  1. All items to be returned or exchanged must be unused and in their original condition with all original tags and packaging intact (for e.g. shoes must be packed in the original shoe box).
  2. Under Exchange Policy,

Note: Exchange/Replacement will be delivered at the same address where the original product was delivered. In case you wish to receive an exchange to a new address, we recommend returning the item for a refund and placing a new order with the new address.

  1. a) If you choose to exchange the item purchased by you on The Fairytale within the specified exchange period for the same size or different size of same style, you will be provided with a replacement of the item.
  2. b) If you choose to exchange item purchased by you on The Fairytale for any other item of the same or different value from The Fairytale. In such case, if exchanged item is of the higher value, differences in amount will be charged to you and if exchanged item is of the lower value, differences in amount will be refunded to you post successful return of the picked up order to warehouse.
  3. c) Net amount paid by you (excluding instant cashback/discount) to purchase original item will be considered to calculate difference in amount of original and exchanged item which will be payable by you or refundable by The Fairytale as the case may be, for an exchange.
  4. d) Applicable refund for any exchange will be trigger post successful delivery of original item from you to warehouse.

6) Exchanges are only allowed for pin codes which are serviceable for an exchange.

7) Item cannot be exchanged for multiple products and you are allowed to select single item for exchange. While customer can exchange multiple item at a time by initiating separate exchange request for each of the item.

8) Non- returnable products/categories cannot be exchanged.

9) Platform Handling Fee (as defined under ‘Terms of Use’) is not applicable to exchanged orders.

10) The Fairytale shall reserve the right to restrict exchange of the items purchased on The Fairytale if customer in any way breaches or misuse this policy, as determined in The Fairytale sole discretion. In case you have purchased an item which has a free gift/offer associated with it and you wish to return the main item, then you will have to return the free product as well.

11) The Fairytale will not be liable for the products returned by mistake. In circumstances where an extra or a different product is returned by mistake, The Fairytale would not be accountable for misplacement or replacement of the product and is not responsible for its delivery back to the User.

12) If you self-ship your returns, kindly pack the items securely to prevent any loss or damage during transit. For all self-shipped returns, we recommend you use a reliable courier service.

13) If you self-ship your returns, make sure you share with us the image of the courier receipt and it validated by us. For self ship returns the refund for returned products will only be initiated if they pass through a quality check conducted at the warehouse. If the quality check fails, there will be no refund and no replacement.

To return a product to The Fairytale, please follow these steps:

You can return products purchased from The Fairytale within the specified return/exchange period(check product details page for the same), except for our non-returnable products and high-value products which can only be returned for limited number of days.

  1. Create a 'Return Request' under “My Orders” section of App/Website/M-site. Follow the screens that come up after tapping on the 'Return’ button. Please make a note of the Return ID that we generate at the end of the process. Keep the item ready for pick up or ship it to us basis on the return mode
  2. We offer pick-up facility in selected locations basis our courier serviceability.
  3. If reverse pick-up option is not available at your location you can self-ship the product to us

Pick-up: If you select to schedule a pick-up, please place the product in a packet and the product must be unused, unwashed and all the tags are intact. Keep the packet ready and open to expedite the return pickup. Our staff may initially examine the product at the time of pickup and a further quality check of the product will be conducted at our Returns Desk.

Self-ship: In case your area pincode is not eligible for “Pick-up” mode then, please self-ship the product to our Returns desk. Please pack the product and ensure product is unused, unwashed and all the tags are intact. Also, please mention Order No and Return id on a piece of paper and place it in the packet. Kindly address the package to the address of the Returns desk closest to you. We have listed out the addresses of the Returns desk in another section on this page.

We will send you a confirmation email as soon as we receive the shipment at our warehouse. At any time, you can track the status of your return request on Website.

  1. How do I place an exchange request on The Fairytale?

If you would like to exchange products purchased from The Fairytale, please follow below mentioned steps:

  1. You can create exchange for products purchased from The Fairytale within the specified return/exchange period (check product details page for the same) under “My Orders” section of Website. If your address is serviceable for exchange you will be able to proceed and generate an exchange id. Please note down your exchange id for future reference
  2. Place the product in a packet but do not seal it. Please ensure product is unused, unwashed with all the tags intact.
  3. Hand over the original product to our delivery staff and receive the exchange item from him. Please ensure that you have the original item available with you at the same address which has been selected for delivery of the exchange item.
  4. At any time, you can track the status of your exchange requests under “My Orders” of Website.
  1. Why has my return been put on hold despite No Questions Asked Returns Policy?

At the time of creating a return, customers are requested to confirm (via a check box click) that the product being returned is unused with original tags intact. At the time of pickup, if the above conditions are not found to be met, your return may be put on hold pending further clarification with our Customer Support.

  1. How long would it take me to receive the refund of the returned product?

After the refund has been initiated by The Fairytale as per the Returns Policy, the refund amount is expected to reflect in the customer account as per the following timelines:

  1. NEFT - 1 to 3 business days post refund initiation
  2. The Fairytale Credit – Instant post the return reaches the warehouse
  3. Online Refund – 7 to 10 days post refund initiation, depending on your bank partner
  4. PhonePe/Other wallet – Instant post the return reaches the warehouse

 

Please note, The Fairytale initiates the refund after the returned item has reached us and quality check is successful. Therefore, the refund initiation time may vary by time taken by the courier partner to deliver the return to a The Fairytale warehouse. In case of any refund discrepancies, The Fairytale may at its sole discretion, request you to share with us a screenshot of your bank statement.

  1. How do I return multiple products from a single order?

If you are returning multiple products from a single order at the same time, then, you will receive same Return ID via e-mail for all items. If you are returning multiple products from a single order but at different times, then, you will receive a separate Return ID via e-mail for each item. If you are self-shipping the products, you can ship all the products in a single shipment. Please mention the Return IDs for all the products on a single sheet of paper and place it inside the packet. If mode of return is Pickup, our courier person will pickup the products from the pickup address.

  1. Does The Fairytale pick up the product I want to return from my location?

Currently, we pick up products only from selected PIN Codes. If your area pincode is serviceable, you will be able to select the pickup option when you create a Return Request on Website. Please note that you will be charged for reverse shipping if you create a return/replacement on The Fairytale.

  1. We will pick up the return within 4 - 7 days from the request placement date.
  2. Please keep the return shipment ready.
  1. How can I Self-Ship the product to The Fairytale?

If your area pin code is not serviceable for pickup, you will need to self-ship the return item via any reliable courier partner. Please ensure to place a sheet of paper with the details of Order ID and Return ID for each item included in the package. Therefore, please ensure that scan copy of courier bill/receipt is shared via Contact us option available on Website. The courier bill/receipt should satisfy the following conditions for successful processing:

  1. It should capture the weight of the return package.
  2. Residential/office address, destination address, shipment date, amount and other details should be mentioned.
  3. The information on the receipt should NOT be edited/over-written.
  4. The courier charge (amount mentioned on the receipt) will not be reimbursed as the reverse shipping is charged to the customer.

**NOTE: For all returns/replacement, the customer will be charged a reverse shipping charge which will be deducted from their paid amount during refund processing.

**In case the return/replacement is being made due to the delivered order being defected or due to a mismatch of size made by The Fairytale, there will be no reverse shipping charge. However, the same has to be proved with either snapshot/video of the package being opened within first 48 hours of the order being delivered.

  1. Why has my return request been declined?

This may have happened, if the item you returned is used, damaged or original tags are missing. In the event that the return request is declined, the user shall not be eligible for a refund, and The Fairytale assumes no liability in this regard. For more details, please call our customer care.

  1. Why did the pick up of my product fail?

We make three attempts to pick up the item, if the item is not picked up in the third attempt, Pickup request will be marked as failed. You can initiate a new return request, if item meets the return criteria and is within the specified return/exchange period (check product details page for the same). For more details, please call our customer care.

NOTE: In the cases where the customer is eligible for the refund, for all prepaid orders made on website, the refund will go back to the original payment method. For all cash on delivery orders, please contact our customer support and provide a UPI ID or bank account number for the refund to process. Please note all refunds will be made after deducting the shipping and reverse shipping charges and will only be processed once the product has reached the warehouse and has passed quality check.

 

 

 

 

 

 

 

 

 

 

 

Payments

  1. How can I pay for my order at The Fairytale?

We support the following payment options at The Fairytale:

  1. Cash On Delivery (available in selected pin codes)
  2. Credit Card
  3. Debit Card
  4. Net banking
  5. The Fairytale Gift Card
  6. Wallet

 

  1. How does the COD (Cash on Delivery) payment option work?

The Fairytale's Cash on Delivery option allows you to pay order value at the time of delivery for all orders between Rs. 299 and Rs. 4,999. Your existing limits will be revised once, there is a delivery or order rejected against your account, from the new limit implementation logic, if required. To pay for any order using Cash on Delivery (COD) mode of payment, please select the 'Cash On Delivery' option on the payment page. Cash on Delivery option is available only in selected pincodes. However the COD limit may differ from customer to customer depending upon the order rejection percentage from a particular customers registered email id. For avoidance of doubt, 'Order Rejection Percentage' shall mean any undelivered orders which are returned from the address provided by the customer even, after three successful delivery attempts. In event of COD limit breach, your order will be cancelled and you will have to place a new order using Pre-payment options.

Further, the COD limit for any user may get decreased to any amount deemed acceptable by The Fairytale basis on order rejection percentage and can be reset to Rs.4,999 basis on Order acceptance percentage and number of prepaid orders placed, post limit decrease.

  1. Does The Fairytale accept Rs. 2,000 currency notes for Cash on Delivery (COD) payments?

Effective September 20, 2023, we will no longer be able to accept Rs. 2,000 currency notes for Cash on Delivery (COD) orders, in compliance with the guidelines provided by the Reserve Bank of India on May 19, 2023.

  1. I have placed a Cash on Delivery (COD) order and intended to pay with Rs. 2,000 notes, but the Delivery Associate is not accepting them. What should I do in this situation?

As per the RBI laid guidelines, The Fairytale is not accepting Rs. 2000 notes for COD, effective September 20, 2023.

Instead, you can choose a UPI method of payment or use alternate currency notes to make the payment.

In case you are unable to arrange for an alternate currency, please consider rescheduling your delivery. Request the Delivery agent to reattempt the delivery.

  1. Why can't I see the COD option on my payment page?

If you do not see a COD option on your payment page, this may be due to one of the following reasons:

  1. Your order value may be less than Rs. 299 or over Rs. 4,999.
  2. Our courier partners may not support the Cash on Delivery option for your delivery address.
  3. You may have placed another order using the COD option which is pending delivery. If the amount of this order when added to your current order exceeds Rs. 4,999, then the COD option will be disabled temporarily.
  1. What is COD limit?

The Fairytale reserves the right to determine the COD limit for every customer and/or orders. The COD limit includes any undelivered, unpaid orders and any new orders being placed.

  1. What is The Fairytale's Cash/Pay on Delivery Fee (COD) Fee?

We apply a small fee for Cash/Pay on Delivery orders towards the handling costs of such orders.

  1. Refund Policy for Cash/Pay on Delivery Fee (COD):

The COD fee is non-refundable in case of an unlikely event of cancellation (partial or full) or return of the order. Please note that the order value considered for refunds is calculated after all discounts, VAT/ GST, or any other applicable charges have been applied.

  1. I want to know about EMI (credit card) payment option?

EMI (Credit Card) is a convenient payment option that you can choose to pay for the order in easy installments to the credit card issuing bank. The option is available only on credit cards issued by the following banks:

  1. HDFC
  2. ICICI
  3. SBI
  4. Axis
  5. Amex
  6. HSBC
  7. Induslnd
  8. Kotak
  9. RBL
  10. Standard Chartered.

This EMI option is facilitated by the card issuing bank. The EMI eligibility, payment plan and refund rules are solely on the internal discretion and approvals of the bank.

  1. How do I make payment using EMI (Credit Card) option?

Add the desired products to your The Fairytale shopping bag, proceed to checkout, select delivery address and proceed to payment. On payment page, select EMI (Credit Card) under payment options and follow these simple steps:

  1. Select your Credit Card issuing bank you wish to pay from
  2. Select the repayment duration (3, 6, 9, 12, 18 or 24 months). The interest rate, monthly EMI and total interest paid will be displayed.
  3. Enter your Credit Card details
  4. Click ‘Pay Now’.

The order will be confirmed and shipped on successful payment.

  1. What is the eligibility criteria to avail EMI option?

EMI is available for all products on The Fairytale. Also, the payment option is available only above a minimum order value which varies from bank to bank. For given order value, only the eligible banks will be displayed under the issuing bank list on the EMI payment page.

  1. Why is sum total of EMI’s more than the order value?

The issuing bank charges interest per EMI transaction. The interest rates are decided by the bank and are displayed at the time of completing the transaction. There is no processing or shipping fees charged on any EMI transactions.

  1. What happens if bank rejects EMI conversion?

Customer needs to pay full amount of transaction to the bank, since EMI facility is at sole discretion of the issuing bank, please contact your card issuing bank.

  1. Why is the transaction amount not converted into EMI in 7 working days?

Conversion of transaction into EMI is at the sole discretion of card issuing bank and can also be rejected in unfortunate circumstances. In case the paid amount is not converted to EMI within 7 days then contact your card issuing bank.

  1. What should I do if my payment fails?

Please retry making the payment after ensuring that the information entered is accurate, including all account details, billing addresses and passwords. If your payment still fails, you can use the Cash on Delivery (COD) payment option, if available on the payment page to place your order. If your payment is debited from your account after a payment failure, it will be credited back within 7-10 days, after we receive a confirmation from the bank.

  1. I am being charged GST amount on my order. What is GST?

GST is a single tax on the supply of goods and services that is levied on every value addition (through production and services) and is added to a product's sale price. GST has to borne/paid by the ultimate consumer of the product or service. If your order is fulfilled on or after July 1st 2017, GST will be applicable on your orders. GST subsumes all other taxes like Excise duty, VAT, Entry tax etc.

  1. How is the GST amount decided?

Following rules will govern whether or not additional GST will be applicable on the products purchased by you:

1) GST applicability:

(a) For a product,

(i) if the fulfillment is done on or after July 1st, 2017 and

(ii) if the order is placed before 15th November, 2019, and,

then GST may be collected from customer in addition to product price, post discounts. The discounts include those resulting from special offers such as Buy 1 Get 1 and similar offers.

(b) For a product, if the order is placed on or after 15th November 2019, the discounted prices displayed on The Fairytale platform shall be inclusive of all taxes, including GST.

2) GST amount: If applicable, the amount of GST collected from customer depends on category, for example

(i) Apparel/Clothing: Max 12%

(ii) Accessories/Other Categories: Max 28%

3) On and from 15th November, 2019, the discounted prices displayed on the The Fairytale platform shall be inclusive of all taxes.

  1. If I return/cancel the purchased product will the GST/VAT amount charged be refunded?

Yes. If you return the product the applicable GST/VAT amount will also be refunded into the source account selected at the time of return initiation. However no refunds of GST/VAT shall be made in relation to platform handling fee collected from the consumer under The Fairytale shipping policy.

  1. Disclaimer on Charges levied?

In our journey to provide best-in-class shopping experience to its customers, The Fairytale may undertake various tests and experiments from time to time. These could result in some deviations from normal for a small set of users for a limited window of time, depending on multiple factors in their purchase history and may affect the charges levied.

 

 

 

The Fairytale Credit

  1. How can I add money into The Fairytale Credit?

You may add money in The Fairytale Credit in following ways -

  1. Refunds to The Fairytale Credit - You may take refunds of returned items.
  1. How do I check balance in my The Fairytale Credit?

You need to sign-in your Account in The Fairytale App or Website and go to your profile. There, in the The Fairytale Credit tab, you shall be able to see the The Fairytale Credit Balance amount.

  1. How do I use The Fairytale Credit to buy items on The Fairytale Website?

You shall be able to use The Fairytale Credit as a Payment method available at the checkout.

  1. Can I redeem The Fairytale Credit to Cash?

You may not redeem The Fairytale Credit for Cash. The Fairytale Credit is also not allowed to be transferred to Bank, Wallets or other users accounts.

  1. Can I buy items on other e-commerce websites with The Fairytale Credit?

The Fairytale Credit can only be used to purchase products at The Fairytale Website. It cannot be used to purchase or pay for anything on other ecommerce websites/apps.

  1. Do I need to have an account on The Fairytale Website to use The Fairytale Credit?

No, The Fairytale Credit does not require a The Fairytale Account.

  1. Can I transfer my The Fairytale Credits to another The Fairytale Account?

The Fairytale Credit cannot be transferred to other The Fairytale users accounts. It can also not be used to pay for purchased being made by other The Fairytale Account users.

  1. Can my The Fairytale Credit account be suspended/closed?

The Fairytale Credit account may be suspended or closed if your The Fairytale Account is suspected of not meeting the policy guidelines.

  1. What happens to my The Fairytale Credit if I am not able to access my The Fairytale Account?

Your The Fairytale Credit account is still active, you may reset your The Fairytale Account password or take help of customer care team to gain access to your The Fairytale Account.

  1. What happens to my The Fairytale Credit if I don’t use The Fairytale website for over 1 year?

Your The Fairytale Credit account stays active, however please note that every credit transaction into The Fairytale Credit comes with an expiry time, at which a part or full amount from your The Fairytale Credit will expire.

  1. What happens if someone uses The Fairytale Credit from my The Fairytale account without my permission?

You need to protect your The Fairytale Account. If someone gets unauthorized access to your The Fairytale Account, they may use your The Fairytale Credit to purchase products at The Fairytale on your behalf without your knowledge.

  1. What happens if I return the Items which I have bought with The Fairytale Credit?

The refunded amount of these returned items shall be added to your The Fairytale Credit.

  1. Can I pay for an Item partially from The Fairytale Credit and Partially from other payment options?

Yes, you may use other payment methods available to pay along with The Fairytale Credit. However, the money shall be deducted from The Fairytale Credit first and the remaining amount can be paid through other available online payment methods.

  1. Can I decide the amount which I can pay from the The Fairytale Credit and the rest from other payment options?

If you have balance in your The Fairytale Credit, then that will be used first. The remaining amount, if any, might be paid through other available online payment methods.

  1. Can I decide to not pay through The Fairytale Credit, even though I might have amount available?

If user has The Fairytale Credit balance, then it is up to the user to use it, however if The Fairytale Credit is being used then the order value will first be taken from The Fairytale Credit and the remaining order value, if any, shall be paid by other available online payment method.

  1. Is there any maintenance charge for keeping The Fairytale Credit?

There are no maintenance charges for keeping The Fairytale Credit Balance.

  1. What is the maximum validity of The Fairytale Credit?

The Fairytale Credit has maximum expiry time of 1 year for refunds and top ups. For each credit to The Fairytale Credit, you shall see a corresponding expiry date for the balance. Please ensure that you use the amount before expiry, after that it shall lapse.

There is no minimum amount to keep in The Fairytale Credit. It can go upto 0.00 as well.

Welcome to The Fairytale. This document is an electronic record in terms of Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 ) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of The Fairytale marketplace platform - www.TheFairytale.in (hereinafter referred to as "Platform")

The Platform is owned by The Fairytale, having its registered office at 3rd Floor, 880/2, Shri Ram Market, Nyay Khand 2, Kala Patthar Road, Indirapura, Ghazibad, Uttar Pradesh-201014, India.

Your use of the The Fairytale and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the The Fairytale including the applicable policies which are incorporated herein by way of reference. By mere use of the The Fairytale, You shall be contracting with The Fairytale, the owner of the Platform. These terms and conditions including the policies constitute Your binding obligations, with The Fairytale.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on Platform by providing data while registering on the Platform as Registered User. The term "The Fairytale","We","Us","Our" shall mean The Fairytale Designs Private Limited and its affiliates.

When You use any of the services provided by Us through the Platform, including but not limited to, (e.g. Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by The Fairytale Policies including but not limited to Privacy Policy as amended from time to time.

  1. User Account, Password, and Security:

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or not in accordance with this Terms of Use, We shall have the right to indefinitely suspend or terminate or block Your access on the Platform.

If there is reason to believe that there is likely to be a breach of security or misuse of Your account, We may request You to change the password or we may suspend Your account without any liability to The Fairytale, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.

In the event of a device being associated with multiple logins or sign ups, as a measure to enhance customer's security and privacy as well as safeguarding your sensitive information for any potential risks, The Fairytale sometimes consider moderating users and their association with devices while using the The Fairytale website.

Your mobile phone number is treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address is up to date on the Platform at all times. You agree to notify Us promptly if your mobile phone number or e-mail address changes by updating the same on the Platform through an OTP verification. You agree that The Fairytale shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on the Platform. You agree to immediately notify The Fairytale of any unauthorized use/breach of your password or account.

If You share or allow others to have access to Your account on the Platform ("Account"), by creating separate profiles under Your Account, or otherwise, they will be able to view and access Your Account information, You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.

If You have not accessed Platform for a period of 2 (two) Years, Your data (including transactional data) will be deleted from Our record and You will not be able to access such data.

  1. Services Offered:

The Fairytale provides a number of Internet-based services through the Platform. One such Service enables Users to purchase original merchandise such as clothing and accessories from our brand. The Products can be purchased through the Platform through various methods of payments offered. The sale/purchase of Products shall be additionally governed by specific policies of sale, like cancellation policy, exchange policy, return policy, etc. (which are found on the FAQ tab on the Platform and all of which are incorporated here by reference). It is clarified that at the time of creating a return request, users are required to confirm (via a check box click) that the product being returned is unused and has the original tags intact. If the product returned by the user is used, damaged or if the original tags are missing, the user’s return request shall be declined, and the said product shall be re-shipped back to the customer. In the event that the return request is declined, the user shall not be eligible for a refund, and The Fairytale assumes no liability in this regard. Further, in the event that the user fails to accept the receipt of the said re-shipped product, the user shall continue to be not eligible for a refund, and The Fairytale assumes no liability with respect to the return or refund for the said re-shipped product. In addition, these Terms of Use may be further supplemented by Product specific conditions, which may be displayed with that Product.

The Fairytale does not warrant that Product description or other content on the Platform is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

  1. Platform for Transaction and Communication:

The Users utilize to meet and interact with one another for their transactions on the Platform. The Fairytale is not and cannot be a party to or control in any manner any transaction between the The Fairytale's Users. Henceforward:

  • The Fairytale does not make any representation or Warranty as to specifics (such as quality, value, salability, etc) of the products or services proposed to be sold or offered to be sold or purchased on the Platform.
  • Pricing on any product(s) as is reflected on the Platform may due to some technical issue, typographical error or product information published by seller may be incorrectly reflected and in such an event we may cancel such your order(s).
  • You release and indemnify The Fairytale and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the The Fairytale and specifically waive any claims that you may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, The Fairytale cannot take responsibility or control the information provided by other Users which is made available on the Platform.
  1. User Conduct and Rules on the Platform:

You agree, undertake and confirm that Your use of the Platform shall be strictly governed by the following binding principles:

  • You shall not host, display, upload, modify, publish, transmit, update or share any information which:
    • belongs to another person and to which You do not have any right to
    • is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever
    • is misleading in any way
    • involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming"
    • promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous
    • infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity
    • contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page)
    • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses
    • contains video, photographs, or images of another person (with a minor or an adult).
    • tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users
    • interferes with another USER's use and enjoyment of the Platform or any other individual's User and enjoyment of similar services
    • infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products
    • violates any law for the time being in force
    • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to thecommission of any cognizable offence or prevents investigation of any offence or is insulting any other nation
    • shall not be false, inaccurate or misleading
    • shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers
  • A User may be considered fraudulent or loss to business due to fraudulent activity if any of the following scenarios are met:
    • Users doesn't reply to the payment verification mail sent by The Fairytale
    • Users fails to produce adequate documents during the payment details verification
    • Misuse of another Users's phone/email
    • Users uses invalid address, email and phone no.
    • Overuse of a voucher code
    • Use of a special voucher not tagged to the email ID used.
    • Users returns the wrong product
    • Users refuses to pay for an order
    • Users involved in the snatch and run of any order
    • Miscellaneous activities conducted with the sole intention to cause loss to business/revenue to The Fairytale
    • User with excessive returns
    • Repeated request for monetary compensation for fake/used order
  • The Fairytale may cancel any order that classify as 'Bulk Orders'/'Fraud orders' under certain criteria at any stage of the product delivery. An order can be classified as 'Bulk Order'/'Fraud Order' if it meets with the below mentioned criteria, and any additional criteria as defined by The Fairytale:
    • Products ordered are not for self-consumption but for commercial resale
    • Multiple orders placed for same product at the same address, depending on the product category.
    • Bulk quantity of the same product ordered
    • Invalid address given in order details
    • Any malpractice used to place the order
    • Any promotional voucher used for placing the 'Bulk Order' may not be refunded
    • Any order paced using a technological glitch/loophole.
  • You shall not use the Platform for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company and interrupt or causes to interrupt, damages the use by other Users of The Fairytale.
  • You shall not use any false e-mail address, impersonates any person or entity, or otherwise misleads The Fairytale by sharing multiple address and phone numbers or transacting with malefice intentions.
  • We on certain landing page even allow our Users to experience free exchange of ideas and observations regarding interest in the field of fashion, including ‘viewing user generated content’ and/or ‘videos’ and ‘posting comments’. By accessing, viewing and/or posting any user generated content to any specific dedicated page on the Platform, you accept and consent to the practices described in these ‘Terms of Service’ and ‘Privacy Policies’, as well as any other terms of prescribed by the The Fairytale on the Platform. You agree and undertake that when accessing, viewing and/or posting any user generated content on these pages You will not imitate, abuse, harass, any Customer/User or violate and exploit, any of these ‘Terms of Service’ of the Platform.
  • You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. We reserve Our right to bar any such activity.
  • You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, password "mining" or any other illegitimate means.
  • You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity
  • You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.
  • You shall not engage in advertising to, or solicitation of, other Users of the Platform to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Platform or related to us.
  • AI Generated Tags for review are powered by ChatGPT from OpenAI and Microsoft. Please go through the complete reviews by the users for detailed information.
  • The Fairytale hereby disclaims any guarantees of exactness as to the finish, appearance, size, color etc., of the final Product as ordered by the User. The Fairytale Return & Exchange Policy offers you the option to return or exchange items purchased on The Fairytale within the return/exchange period (Please read the Product Detail Page to see the number of days upto which a product can be returned/exchanged, post-delivery). In case of return or exchange of the purchased item, please refer to the "Return and Exchange Policy" available on the website.
  • Please note that you can only use The Fairytale Credits to buy products from your registered account on the The Fairytale app or website. The Fairytale Credits cannot be:
  • Used for payment of orders placed on other The Fairytale accounts.
  • Transferred to any other The Fairytale user's account, bank account, or wallets, etc.
  • The Fairytale may unilaterally terminate Your account on any event as mentioned in the Terms Of Use under the point no. 4. User Conduct and Rules on the Platform. Any The Fairytale credits earned as goodwill compensation, earned via loyalty or referral program or promotional campaigns or earned through gift cards purchased on other platforms will be forfeited in such cases.
  1. Contents Posted on Platform:

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork (collectively, "Content"), is a third party user generated content and The Fairytale has no control over such third party user generated content as The Fairytale is merely an intermediary for the purposes of this Terms of Use. Such Content will become Our property and You grant Us the worldwide, perpetual and transferable rights in such Content. We shall be entitled to, consistent with Our Privacy Policy as adopted in accordance with applicable law, use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the Content You provide.

You may use information on the products and services purposely made available on the Platform for downloading, provided that You

  • do not remove any proprietary notice language in all copies of such documents,
  • use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media,
  • make no modifications to any such information, and
  • do not make any additional representations or warranties relating to such documents,
  • In the event of return/cancellation of any products in the order placed with an offer, thereby falling below the minimum required threshold as required by the offer, the user shall be deemed ineligible for the offer. Any cashback already credited would be void & be deducted from the value of the item being returned/canceled & the remaining balance would be processed as a refund.The Fairytale reserves the right to modify the terms and conditions at any time, without prior notice..
  1. Disclaimer of Warranties and Liability:

All the materials and products (including but not limited to software) and services, included on or otherwise made available to You through Platform are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, The Fairytale does not warrant that: Platform will be constantly available, or available at all or The information on Platform is complete, true, accurate or non-misleading.

All the Products sold on Platform are governed by different state laws and if Seller is unable to deliver such Products due to implications of different state laws, Seller will return or will give credit for the amount (if any) received in advance by Seller from the sale of such Product that could not be delivered to You. You will be required to enter a valid phone number while placing an order on the Platform. By registering Your phone number with us, You consent to be contacted by Us via phone calls and/or SMS notifications, in case of any order or shipment or delivery related updates. We will not use your personal information to initiate any promotional phone calls or SMS.

  1. Payment

Payment Facility for Buyers:

  • You, as a Buyer, understand that upon initiating a Transaction You are entering into a legally binding and enforceable contract with the Seller to purchase the products and /or services from the Seller using the Payment Facility, and You shall pay the Transaction Price through Your Issuing Bank to the Seller using Payment Facility.
  • You, as a Buyer, may agree with the Seller through electronic communication and electronic records and using the automated features as may be provided by Payment Facility on any extension / increase in the Dispatch and/or Delivery time and the Transaction shall stand amended to such extent. Any such extension / increase of Dispatch / Delivery time or subsequent novation / variation of the Transaction should be in compliance with Payment Facility Rules and Policies.
  • You, as a Buyer, shall electronically notify Payment Facility using the appropriate The Fairytale Platform features immediately upon Delivery or non Delivery within the time period as provided in Policies. Non notification by You of Delivery or non Delivery within the time period specified in the Policies shall be construed as a deemed Delivery in respect of that Transaction. In case of Cash On Delivery transactions, Buyer is not required to confirm the receipt of products or services.
  • You, as a Buyer, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, whichever is earlier. In case you do not raise a refund claim using Platform features within the stipulated time than this would make You ineligible for a refund.
  • You, as a Buyer, understand that the Payment Facility may not be available in full or in part for certain category of products and/or services and/or Transactions as mentioned in the Policies and hence You may not be entitled to a refund in respect of the Transactions for those products and /or services
  • Except for Cash On Delivery transaction, refund, if any, shall be made at the same Issuing Bank from where Transaction Price was received, or through any other method available on the Platform, as chosen by You.
    • For Cash On Delivery transactions, refunds, if any, will be made via electronic payment transfers.
  • Refund shall be made in Indian Rupees only.
  • For electronics payments, refund shall be made through payment facility using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).
  • Refunds may be supported for select banks. Where a bank is not supported for processing refunds, You will be required to share alternate bank account details with us for processing the refund.
  • Refund shall be conditional and shall be with recourse available to The Fairytale in case of any misuse by Buyer.
    • We may also request you for additional documents for verification.
  • Refund shall be subject to Buyer complying with Policies.
    • The Fairytale reserves the right to impose limits on the number of Transactions or Transaction Price which The Fairytale may receive from on an individual Valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual Buyer during any time period, and reserves the right to refuse to process Transactions exceeding such limit.
  • The Fairytale reserves the right to refuse to process Transactions by Buyers with a prior history of questionable charges including without limitation breach of any agreements by Buyer with The Fairytale or breach/violation of any law or any charges imposed by Issuing Bank or breach of any policy.
  • The Fairytale may do such checks as it deems fit before approving the receipt of/Buyers commitment to pay (for Cash On Delivery transactions) Transaction Price from the Buyer for security or other reasons at the discretion of The Fairytale. As a result of such check if The Fairytale is not satisfied with the creditability of the Buyer or genuineness of the Transaction or other reasons at its sole discretion, The Fairytale shall have the right to reject the receipt of / Buyers commitment to pay Transaction Price. For avoidance of doubt, it is hereby clarified that the ‘Cash on Delivery’ feature for payment, may be disabled for certain account users, at the sole discretion of The Fairytale.
  • The Fairytale may delay notifying the payment confirmation i.e. informing Seller to Dispatch, if The Fairytale deems suspicious or for Buyers conducting high transaction volumes to ensure safety of the Transaction and Transaction Price. In addition, The Fairytale may hold Transaction Price and The Fairytale may not inform Seller to Dispatch or remit Transaction Price to law enforcement officials (instead of refunding the same to Buyer) at the request of law enforcement officials or in the event the Buyer is engaged in any form of illegal activity.
  • The Buyer and Seller acknowledge that The Fairytale will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond control of The Fairytale.

Compliance with Laws:

  • As required by applicable law, if the Customer makes a purchase of an amount equal to or above INR 2 00 000.00, the Customer will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Customer will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Customer, it need not be submitted again. The order of the Customer shall stand cancelled if there is a discrepancy between the name of the Customer and the name on the PAN Card.

Buyer and Seller shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using Payment Facility and The Fairytale Platform.

Buyer's arrangement with Issuing Bank:

  • All Valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company.

All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which support Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective Issuing Bank.

  1. E-Platform for Communication:

You agree, understand and acknowledge that The Fairytale is an online platform that enables you to purchase products listed on the Platform at the price indicated therein at any time. You further agree and acknowledge that The Fairytale is only a facilitator and is not and cannot be a party to or control in any manner any transactions on The Fairytale.

  1. Indemnity:

You shall indemnify and hold harmless The Fairytale, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

  1. Trademark, Copyright and Restriction:

Platform is controlled and operated by The Fairytale and products are sold by respective Sellers. All material on Platform, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Material on The Fairytale is solely for Your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other The Fairytale or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which You receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause. It is expressly clarified that You will retain ownership and shall solely be responsible for any content that You provide or upload when using any Service, including any text, data, information, images, photographs, music, sound, video or any other material which you may upload, transmit or store when making use of Our various Service. However, We reserve the right to use/reproduce any content uploaded by You and You agree to grant royalty free, irrevocably, unconditionally, perpetually and worldwide right to Us to use the content for reasonable business purpose.

  1. Limitation of Liability:

In no event shall The Fairytale be liable for any indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

  • the use or the inability to use the Services or Products
  • unauthorized access to or alteration of the user's transmissions or data
  • breach of condition, representations or warranties by the manufacturer of the Products

The User understands and agrees that any material and/or data downloaded at The Fairytale is done entirely at Users own discretion and risk and they will be solely responsible for any damage to their mobile or loss of data that results from the download of such material and/or data. To the maximum extend that is permissible under law, The Fairytale’s liability shall be limited to an amount equal to the Products purchased value bought by You.   1. Termination:

The Fairytale may suspend or terminate your use of the The Fairytale or any Service if it believes, in its sole and absolute discretion that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Service or anyway otherwise acted unethically.
